Can I still sue almost 3 years later for a car accident?

I got in a car accident in August 2008, and I wasn't at fault. The other person's insurance company said they would pay but they wanted to give us a really small amount and that wasn't enough to fix my car!! We didn't accept the settlement money. We were discussing it and they still haven't paid us and I'm wondering if we can still sue them even though it's been almost 3 years. We live in CA. Thanks
